The one demand made by the former president repeatedly when he was charged with trying to have the results of the 2020 election overturned was absolute presidential immunity.

Recently, the front-runner for the Republican nomination demanded the same on his Truth Social account. On the 18th of January, he wrote, “A PRESIDENT OF THE UNITED STATES MUST HAVE FULL IMMUNITY, WITHOUT WHICH IT WOULD BE IMPOSSIBLE FOR HIM/HER TO PROPERLY FUNCTION.”

Supporters of Trump have been clamouring for protection as he leads the GOP primary polls with a significant lead and won the Iowa caucus handily, setting up a possible rematch for the presidency in November with Vice President Joe Biden.

Regarding total presidential immunity, what did Alina Habba say?

During a Friday, January 19, interview with Martha MacCallum of Fox News, Habba claimed that there had been complete presidential immunity prior to Trump’s election. The lawyer made the comments in reference to the charges levelled against the prosecutor in Georgia about Trump’s alleged election meddling.

“I want the American public to understand that this has existed for me -every president prior since the law was created to create a shelter for presidents, sitting presidents to do what they need to do for the nation without fear of prosecution, civilly and criminally,” she stated.

She went on to say that the only thing holding people back from supporting Trump’s demands was “fear” of his winning the 2024 election and “cleaning up the mess.”

“Now that they’re presenting it, I have to tell you that immunity must continue. They are not required to make it. “They must hold onto it,” Habba informed MacCallum.

The former President’s claims of immunity were rejected by special counsel Jack Smith in late December 2023, arguing that doing so “threatens the democratic and constitutional foundation of our Republic.”
